TOUR
This applies to all passengers whether or not they have their own bike, hires a bike, or ride pillion with another rider.
Jurisdiction
The conclusion of the contract will be at Farout Africa's offices in Kampala Uganda and any matters arising from it will be subject to Ugandan law and the exclusive jurisdiction of the Ugandan Courts.
Cancellation Bookings
Cancellation of any bookings must be received in writing and acknowledged by Farout Africa Ltd. The following fees will apply: (a) If notification received 28 days prior to departure loss of 30% deposit (b) 27-14 days prior to departure loss of 70% of tour cost (c) 13 0 days prior to departure loss of 100% of tour cost.
Changes to Booking Date Made by You
Subject to availability and agreement with our reservations office, booking dates may be changed for a GBP100 fee. If Farout Africa Extreme cannot help with alternative dates, normal cancellation fees will apply. If you subsequently cancel your reservation, the fees will be calculated based on your original booking.
Changes or Cancellation Made by Farout Africa Ltd.
Every effort is made to operate itineraries as advertised. However, we do plan arrangements well in advance and occasionally have to make changes for whatever reason. Farout Africa Extreme, reserves the right to do so at any time.Due to local conditions and unforeseen circumstances, Farout Africa Extreme or its employees may altar the itinerary of a tour in anyway with no refund to the client. In the event of a major disruption as a result of, including but not limited to, weather conditions, mechanical breakdown, sickness, political instability or acts of terrorism (perceived or actual), or other factors after the time of departure, every effort will be made to utilize alternative arrangements. If additional expenses are incurred through delay, accident or disruption beyond the control of the company, such expenses must be borne solely by the client.
Farout Africa Extreme. reserves the right to cancel any tour and either offer an alternative, or refund the money's paid in full. This will however be in rare circumstances.
Your Responsibilities
In addition to the above, the client agrees to strictly abide by the laws and regulations of each country we visit, and to abide by the instruction of the guide with regards to safety and the running of the tour. The client agrees to indemnify Farout Africa Extreme. for any accident, damage to property or personal injury caused by the client during the tour. Clients are responsible for checking in on time and for reconfirming flight times. Farout Africa Extreme. Cannot be responsible for delays caused by airline flight alterations, cancellations or delays. If rescue or medical assistance is required for any reason, the client shall be liable for the entire cost. The client acknowledges that the nature of the holiday is adventurous, and that such tours involve an element of personal risk, and that Farout Africa Extreme or its agents cannot be held responsible for injury, accident, damage to property, or loss of life, delay or inconvenience, howsoever caused. The client accepts responsibility for the risks involved.
Other Conditions
When you book excursions not operated by Farout Africa Extreme (whether recommended by the company or not), Farout Africa Extreme. will have no legal liability for anything that may go wrong with the excursion and any claim will be against the relevant local operator (e.g. Gorilla trekking etc).
If Farout Africa Extreme considers the client to be unsuitable for a tour it may in its absolute discretion cancel the clients booking or decline to carry the client further if that client causes inconvenience, annoyance or danger to other clients.
If the client has a complaint whilst on tour they must bring it to the guides attention so it can be dealt with. If the matter isn't resolved whilst on tour, the client must write to Farout Africa Extreme within 28 days of completion of the tour. Farout Africa Extreme will not entertain complaints of Loss of Enjoyment where full land arrangements have been provided.
Insurance
Comprehensive travel insurance covering cancellation, curtailment, medical, emergency travel and personal accident is compulsory on all tours. Insurance for loss of baggage, money or personal items is strongly recommended. If you choose to rely on your credit card for cover, we strongly recommend that you fully understand the terms and conditions of any cover.
Health
it is the responsibility of the client to consult a health professional with respect to recommended and compulsory vaccinations and heath precautions. The client confirms they are in good health. Any pre-existing medical condition must be declared at the time of booking and the client must make arrangements for the provision of drugs or other treatment that may be required during the tour.
Passports, Visas, Cross border Paperwork
Obtaining visas and compliance with documentation requirements is the responsibility of the client, including cross border paperwork if the client is using their own motorcycle. Any information given by Farout Africa Extreme is done so in good faith but without responsibility on the part of Farout Africa Extreme.
Full Payment
Full payment is due 4 weeks prior to departure. If full payment is not received by this time Farout Africa Extreme may treat the booking as cancelled. Any booking made within 4 weeks of departure must be accompanied by full payment.
Onward travel arrangements should be made for the day after the tour ends. If arrangements are made for the same day the tour ends, Farout Africa Extreme cannot be held responsible for any delays resulting in failure to meet those arrangements.
Minimum Age
The minimum age for Farout Africa Extreme tours is 21 years.
Motorcycle Hire
If you are hiring a motorcycle from Farout Africa Extreme, the following terms and conditions apply in addition to the above:
Use of Motorcycle The motorcycle may only be used for tours stipulated in this brochure/web site. At all times the hirer agrees to adhere to the laws of the countries visited. If at anytime the tour guide or other Farout Africa representative deems the hirer to be using the motorcycle negligently, carelessly, without regard for the law or their own or others safety, the hire may be terminated immediately.
Terms of Payment
Payment of the hire cost is due 4 weeks prior to departure. A cash deposit is required at the time of rental and final adjustments are made on termination for insurance excess in case of loss or damage, fines, damages etc. Alternatively Farout Africa Extreme recognize charge cards such as Visa, MasterCard and American Express may be used as an alternative to cash.
Drivers License Hirers must be in possession of a valid, unendorsed national driver’s license. It must have been valid for 2 years prior to departure. If you’re national drivers license is not in English it must be accompanied by an International Driving Permit with a stamped photograph. It is a legal requirement in Uganda that drivers carry their license with them at all times.
Identification
Hirers must present upon departure a valid passport as proof of identity if any other nationality.
Accidents, Loss or Damage to Motorcycle
The hirer agrees to return the bike in the same condition it went out in. The hirer is liable for the amount stipulated in the deposit taken above provided the motorcycle is used in accordance with the terms and conditions of the rental. Notwithstanding this you are liable in full for damage caused by negligence, damage where no other vehicle, person, animal or object is involved, damage caused when motorcycle is ridden by unauthorized drivers, accidents not reported within 24 hours to the nearest Police Station.
